Terms and Conditions of Service

Introduction
Welcome to Lesto Logistics (“Lesto,” “we,” “us,” or “our”). These Terms and Conditions of Service (“Terms”) govern your use of our logistics services, website, and mobile application (collectively referred to as the “Services”). By accessing or using our Services, you agree to comply with and be bound by these Terms.
Service Overview
Lesto Logistics provides logistics and transportation services, including but not limited to same-day deliveries, e-commerce fulfillment, heavy load transportation, and supply chain optimization.
We operate from our address at 279 Morningmist St, Brampton, Ontario, Canada, L6R 2B9.

Service Terms
- Lesto Logistics maintains the right to decline orders at our discretion and cease access to our services without prior notice.
- For a delivery order to be valid, the client must be 18 years of age or older, adhering to guidelines outlined on the Lesto Logistics website or making alternative arrangements agreed upon by Lesto Logistics before delivery.
- All delivery orders must involve legal products, compliant with local, state, provincial, federal, or international laws. Lesto Logistics will not deliver packages deemed illegal and reserves the right to contact the appropriate authorities. Prohibited items include dangerous goods, hazardous materials, firearms, and live animals. Lesto Logistics will not be responsible for any illegal items/packages getting picked up or transported through our services as we do not open packages at the time of booking/pickups.
- The maximum weight and dimensions of cars are restricted, and Lesto Logistics will refuse to deliver orders not complying with these specifications.
- No shipment should proceed without prior confirmation by Lesto Logistics, either through the order form or by recognized means agreed upon by both parties. Lesto Logistics is not liable, financially or otherwise, for deliveries without confirmation.
- Lesto Logistics does not provide protection for products requiring temperature control; such items will be transported at the shipper’s risk of damage by exposure to heat or cold conditions.
- The responsibility for proper packaging lies with the client or shipping agent. Lesto Logistics does not accept responsibility for products damaged due to poor packaging and reserves the right to refuse improperly packaged products without liability for timely delivery. Refunds will not be issued for improperly packaged products.
- Lesto Logistics reserves the right to inspect any package we are solicited to deliver if we deem the package may be in opposition to stated terms and conditions, including opening packages to verify contents.
- In cases of multiple-piece shipments, all items will be billed as one shipment, with details available on the order form and the history dashboard in the Lesto Logistics app.
- Lesto Logistics reserves the right to cancel an order at any time, and if initiated by Lesto Logistics, funds will be refunded to the client.
- If the client cancels an order after Lesto Logistics has made arrangements to dispatch a driver or while a driver is in the process of delivery, the client is still responsible for the payment of the processed order. A new order must be placed, and payment made, even if it is for the same item.
- Lesto Logistics reserves the right to decline any request to redirect to any address not given prior to the driver being dispatched. In cases of redirection, Lesto Logistics will do so at their discretion for an additional cost.
- If Lesto Logistics is unable to deliver a shipment, they will contact the client to notify them of circumstances surrounding the failed delivery attempt. Lesto Logistics will attempt to deliver the package again for a fee if the client was responsible for the failed delivery attempt. If Lesto Logistics failed in its duties to deliver the package and the circumstances surrounding this failed attempt were not sufficient or critical as agreed upon by both parties, then Lesto Logistics will attempt to deliver the package at no cost.
- Lesto Logistics drivers will not wait more than 10 minutes upon reaching pickup or delivery destinations unless otherwise agreed upon by all parties prior to the driver being sent out.
- Lesto Logistics will attempt to contact the client or delivery location by phone, and if no contact is made, additional charges will be added to the initial order cost.
- Insurance options are available for all deliveries; clients should contact their sales account manager for details.
- Clients must provide accurate delivery data for Lesto Logistics to perform their delivery service properly. The client is liable for any inaccurate information and will be charged for any additional costs incurred by Lesto Logistics due to inaccurate information.
- Lesto Logistics does not offer general refunds for the failure of delivery. Refunds are assessed on a case-by-case basis and depend on factors such as order processing, the client not being available when the driver arrives at the pickup destination, natural disasters, or other inclement weather, along with other circumstances outlined in these terms and conditions.
- The method of payment must be agreed upon prior to any driver being dispatched. Any method of payment other than an invoice or through an online system must be agreed upon by Lesto Logistics and the client before the driver is dispatched.
- Lesto Logistics guarantees on-time shipment of an item, unless circumstances outside of the control of Lesto Logistics interrupt such delivery. In cases of failure to meet delivery standards, the package will be prioritized for the next available slot. Expect some delays during peak times. All conditions as outlined in these terms must be followed by the client for any claim of failure to be on time to be considered.
- It is the customer’s responsibility to retain a copy, image, or scan of any important documents being delivered by Lesto Logistics. Liability for each package is limited to $100. Claim forms are available when completing the delivery order with Lesto Logistics. Make sure to select “Fragile / Expensive” when placing the order.
Acceptance of Terms
By using our Services, you accept and agree to these Terms.
If you do not agree with these Terms, please refrain from using our Services.

Lesto Logistics is not liable for any indirect, incidental, consequential, or punitive damages arising from the use of our Services.

We reserve the right to terminate or suspend your access to our Services at our discretion.

Missing Items
If any items are missing from your delivery, please report the issue to us within 24-hours from the delivery date for investigation and resolution.
Limitation of Liability
In no event shall Lesto Logistics’ aggregate liability exceed the fees actually paid by you to Lesto Logistics in the three (3) month period immediately preceding the event giving rise to such claim or $100, whichever is less. In no event shall Lesto Logistics and/or its licensors be liable to anyone for any indirect, punitive, special, exemplary, incidental, consequential, or other damages of any type or kind (including personal injury, loss of data, revenue, profits, reputation, use, or other economic advantage), even if Lesto Logistics and/or its licensors have been previously advised of the possibility of such damages.
The service connects you to couriers and merchants for the purposes of facilitating courier services. Lesto Logistics will not assess the suitability, legality, or ability of any couriers, and you expressly waive and release Lesto Logistics from any and all liability, claims, or damages arising from or in any way related to the couriers. Lesto Logistics will not assess the quality, safety, or legality of the items provided by merchants or retailers on the platform, and you expressly waive and release Lesto Logistics from any and all liability, claims, or damages arising from or in any way related to merchants, retailers, and the items they provide. Lesto Logistics will not be a party to disputes or negotiations of disputes between you and any couriers, merchants, or retailers. Responsibility for the decisions you make regarding services offered via the service rests solely with you. In addition, we will not assess the suitability, legality, or ability of any third parties, and you expressly waive and release Lesto Logistics from any and all liability, claims, causes of action, or damages arising from your use of the service or in any way related to the third parties introduced to you by the service. The quality of the courier scheduled through the use of the service is entirely the responsibility of the third-party courier who ultimately provides delivery services to you. You understand that by using the service, your items may be exposed to situations that are potentially dangerous or harmful, unsafe, or otherwise objectionable, and that you use the service at your own risk.
Notice
Lesto Logistics may give notice by any means of communication reasonably anticipated to notify you of the information provided. By way of example only, such communication may be a general notice on the Service or via email to the email address listed on your Lesto Logistics account. It is your obligation to update your account information so that we may contact you as may be necessary. Such notice shall be deemed to have been given 48 hours after dispatch. If physical notice (e.g., Canada Post) is used, then such notice shall be deemed to have been given 7 days after dispatch.
You may give notice to Lesto Logistics (such notice shall be deemed given when received by Lesto Logistics) at any time by any of the following: letter delivered by nationally recognized overnight delivery service or first-class postage prepaid mail to Lesto Logistics at the following address:

Arbitrator
Any arbitration between you and Lesto Logistics will be governed by the Commercial Arbitration Act (CAA) and the Supplementary Procedures for Consumer-Related Disputes of the ADR Institute of Canada (“ADRIC”), as modified by these Terms, and will be administered by the ADRIC. The ADRIC Rules and filing forms are available online at www.adrcanada.ca, by calling the ADR at 1-877-475-4353, or by contacting Lesto Logistics at support@lesto.ca.
Consent to Use of Data
By using the Lesto Logistics Service, you acknowledge and agree that Lesto Logistics may collect, use, and share certain information about you and your use of the Service as described in our Privacy Policy. This includes but is not limited to:
Personal information provided by you during registration or use of the Service.
Location data and device information collected while you use the Service.
Information about the items you send or receive through the Service.
You consent to the collection, use, and sharing of this data as described in our Privacy Policy. Lesto Logistics takes your privacy seriously and employs measures to protect your data in accordance with applicable laws and regulations.
Push Notifications
By using the Service, you agree to receive push notifications from us on your device. You can opt-out of these notifications at any time by adjusting your device settings.
Email Communications
By using the Service, you consent to receive email communications from us regarding your account, Service updates, and promotional offers. You can opt-out of these communications at any time by following the instructions in the emails.
Text Messaging
By using the Service, you consent to receive text messages from us regarding your account, Service updates, and promotional offers. Message and data rates may apply. You can opt-out of these text messages at any time by replying “STOP.”

We encourage you to provide feedback, comments, and suggestions for improvements to the Service (“Feedback”). You agree that we have the right to use, modify, and incorporate your Feedback without any obligation to you.
Modification of these Terms
We reserve the right to modify or amend these Terms at any time. All changes will be effective immediately upon posting to the Service.
